Court finds it unlawful to cancel sentence of law enforcers for beating a Krasnodar resident

The Court of Cassation for the third time returned to the Krasnodar Territorial Court the criminal case on beating of Yevgeniy Manchenko, a person with disabilities, by law enforcers. The court recognized the cancellation of the sentence as unlawful.

The “Caucasian Knot” has reported that on July 21, 2023, the Krasnodar Territorial Court acquitted Vladimir Tatarkov and Vyacheslav Zyabkin, former patrol-and-post police service inspectors, in the case on beating Yevgeniy Manchenko. Both police inspectors got the right to rehabilitation for “illegal criminal prosecution.” On December 7, the Court of Cassation in Krasnodar cancelled the acquittal and returned the case for reconsideration.

On June 15, 2022, the Prikubansky District Court found Vyacheslav Zyabkin and Vladimir Tatarkov guilty of abuse of power and sentenced them to 4 and 3 years of suspended imprisonment, respectively. However, the Krasnodar Territorial Court upheld the appeal filed by the convicts and cancelled the verdict.

The Fourth Court of Cassation of General Jurisdiction in Krasnodar once again returned the criminal case for consideration to the instance of appeal at the Krasnodar Territorial Court. This is the third time when the court has declared the decisions of the court of appeal in the case on beating of Yevgeniy Manchenko unlawful, the “Team Against Torture” (TaT)* reports.

So, on March 6, the Krasnodar Territorial Court pronounced the decision to cancel the punishment for Vyacheslav Zyabkin and Vladimir Tatarkov and return the case to a public prosecutor “due to the inconsistency of the evidence presented by the prosecution, which does not allow drawing an unambiguous conclusion that the victim suffered a fracture.” The court requested a re-examination on the above-mentioned fact.

Let us remind you that in March 2019, Yevgeniy Manchenko tried to climb over the fence into the yard of his parents’ house because he had lost his keys. At that moment, the police inspectors ran up to him, began to pull him off the fence, and hit him on his leg with a baton. When Evgeniy fell to the ground, the police inspectors continued to beat him, the victim’s mother said, The woman notes that her 23-year-old son is disabled with developmental disabilities. When the parents left the house, the young man was already sitting in a police service car, handcuffed. Later, a medical officer diagnosed Yevgeniy Manchenko with a broken leg.

*The “Team against Torture” (TaT, formerly the “Committee against Torture” – CaT) was created by the lawyers who had earlier worked for the CaT, which was included into the register of the NCOs performing the functions of foreign agents.
