Contract soldier from Novorossiysk continues his struggle to raise his son
Denis Neprokin, a 49-year-old military man from Novorossiysk, re-filed a claim demanding his dismissal from the army. The man has explained that he is a single father and is raising a teenage son, and the commanders deceived him, persuading him to withdraw the first claim from the court and promising to dismiss him from the army. Denis Neprokin has every chance of winning the case in court, since the law on military service has been violated in his case, believes lawyer Roman Lykov.
Denis Neprokin decided to resign from the military service in order to join his child in Novorossiysk. The man submitted his report of dismissal to the commander, but the latter refused the dismissal. Then Denis Neprokin appealed the refusal in court, but the Sochi court recognized the refusal as legal and referred to the fact no such reasons for dismissal from the military service were indicated in the current presidential decree on mobilization.
“My contract expired on September 27, 2022, but on September 21, the presidential decree on partial mobilization was issued, and my dismissal on September 27 was cancelled. By that time, I had already divorced my second wife, and my minor child was left alone without supervision,” Denis Neprokin said .
Earlier, people like him were considered volunteers, but after the announcement of the partial mobilization, all of them were equated to the military personnel, Denis Neprokin noted.
“My child may remain an orphan, and I am actually deprived of my constitutional right to raise him,” Denis Neprokin emphasized.
