BCA rejects complaint of Mukhtarly's defence

The Baku Court of Appeal (BCA) has dismissed the complaint lodged by the defence of journalist Afghan Mukhtarly asking to check his mobile phone and accounts in social networks without the court's sanction.

On July 9, Leyla Mustafaeva, Afghan's wife, told the "Caucasian Knot" that her husband suffered from heart pains and receives no medication.

According to Elchin Sadygov, an advocate, on the day of Mukhtarly's arrest, on May 29, power agents checked the records in his mobile phone, although at that time there was no official judgement on the journalist's detention, and no court sanction for an examination.

In early July, the defence turned to the court demanding to recognize the above actions unlawful. On July 6, the Nasimi District Court dismissed the complaint.

Mr Sadygov has announced his intention to file a complaint with the European Court of Human Rights (ECtHR) against the law enforcers' actions.

According to his version, one complaint about the Mukhtarly's illegal arrest has already been recognized as a priority by the ECtHR.
