ECtHR communicates Khamid Razhapov's complaint

The European Court of Human Rights (ECtHR) has recognized admissible the complaint filed by Khamid Razhapov, a native of Chechnya, accused of attacking staff members of the Ministry for Emergencies (MfE) in the suburban village of Vnukovo. Khamid Razhapov filed to the ECtHR a complaint about violation of his rights in connection with illegal arrest and detention in custody for more than two years.

The "Caucasian Knot" has reported that Khamid Razhapov, Said-Magomed and Khusein Tsetiev were detained in September 2014. According to investigators, they beat MfE's staff members in the suburban village of Vnukovo. Starting from September 2015, the trial in the case took place under the court's decision, and the defendants claimed they had the alibis. On January 6, 2016, their advocates filed a complaint to the ECtHR.

In the excessive period of pre-trial detention, the ECtHR has found signs of violation of Article 5 (right to liberty and security) of the Convention for the Protection of Human Rights and Fundamental Freedoms.

"Everyone who fell victim to arrest or detention in contravention of the provisions of Article 5 shall have the right to compensation," said Tatiana Okushko, an advocate of the natives of Chechnya.
