Court cancels verdict to law enforcers in case on torture of Dagestani native Yulduz Kurashova

The Supreme Court (SC) of Dagestan has cancelled the verdict in the case on torture of Khasavyurt resident Yulduz Kurashova by policemen and returned it to the prosecutor’s office, human rights defenders report.

The “Caucasian Knot” has reported that in October 2022, the Khasavyurt City Court sentenced policemen Shamil Aliev and Ramazan Saipulaev to 3.5 years of imprisonment in a penal colony, finding them guilty of torturing Yulduz Kurashova and falsifying evidence in a criminal case instituted against her. The court also found that criminal investigator Maya Akhmedova was involved in the falsification, and she was sentenced to one year of suspended imprisonment. On December 15, 2022, the court of appeal cancelled the verdict and sent the case for a new consideration. On April 27, the court sentenced Shamil Aliev and Ramazan Saipulaev to suspended sentences and acquitted Maya Akhmedova. Yulduz Kurashova announced her intention to lodge an appeal against the verdict.

On March 26, 2020, law enforcers detained Yulduz Kurashova in Khasavyurt, when she was travelling in a taxi together with her friend. According to the Yulduz Kurashova’s claim, she was beaten, insulted, threatened with deprivation of parental rights and initiation of a drug case. Yulduz Kurashova handed over 250,000 roubles to the law enforcers through an intermediary, but was still subject to criminal prosecution. The case on abuse of power with the use of violence was opened after Yulduz Kurashova had complained about the harsh detention and coercion to incriminate herself in the sale of drugs.

The Supreme Court (SC) of Dagestan has cancelled the sentence to three policemen in the case on beating and falsification of evidence against Yulduz Kurashova. The case has been returned to the prosecutor’s office for further investigation, the “Team Against Torture” (TaT)** reported.

*The “Team against Torture” (TaT, formerly the “Committee against Torture” – CaT) was created by the lawyers who had earlier worked for the CaT, which was included into the register of the NCOs performing the functions of foreign agents.
