ECtHR finds violations of rights of Krasnodar and Rostov-on-Don residents

The European Court of Human Rights (ECtHR) has ruled to pay compensations to participants in protest actions in Krasnodar and Rostov-on-Don, recognizing a violation of their right to an impartial trial.

The applicants complained mainly about disproportionate measures taken against them as organizers or participants of public assemblies, namely about arrests at the dispersal of these assemblies and convictions for administrative offenses.

Compensation of EUR 6000 was awarded to Artyom Safronov, who was detained on March 6, 2022, at a pacifist action held in Rostov-on-Don. He was arrested for 15 days. The ECtHR has treated Safronov's keeping in a paddy wagon for more than two hours and absence of the court's impartiality as violations.

Yaroslav Ryabinin, a resident of Rostov-on-Don, was also detained at the above action held in March 2022. He was also arrested for 15 days. The ECtHR has treated his long detention, absence of the court's impartiality and the delay in the execution of the ruling as violations and awarded him compensation of EUR 5000.

The complaint about the absence of the court's impartiality lodged by Renat Khakimov, a resident of Krasnodar resident, who was detained at a rally in support of Alexei Navalny in April 2021 and fined by 15,000 roubles, has been also granted; he was awarded compensation of EUR 3500.

Two other participants in the above protest action held in April 2021, Ivan Permyakov and Victoria Dolnikova, were fined by 10,000 and 12,000 roubles respectively. The ECtHR has also treated the court's actions as biased, and their detention prior to case consideration – as illegal and awarded them compensation of EUR 4000 each.
