Case on toughening Trepashkin's custody mode returned to Nizhni Tagil

The Sverdlovsk Regional Court has returned the case on toughening Mikhail Trepashkin's custody regime back to the Tagilstroj District Court of the city of Nizhni Tagil. The "Caucasian Knot" correspondent learnt about it from Lyubov Kosik, advocate of the ex-FSB officer who is serving his four-year imprisonment term.

We remind you that on March 9, 2007, the Tagilstroj District Court of Nizhni Tagil made a decision to transfer Mr Trepashkin, allegedly for admitted custody regime violations, from the colony-settlement, where he was serving his verdict, to the general custody colony.

Mikhail Trepashkin and his advocates appealed against this decision in the order of cassation. But the Judicial Collegium for Criminal Cases of the Sverdlovsk Regional Court "believes that there are obstacles for consideration of these cassation complaints."

"...In his numerous applications, Mr Trepashkin asked to send to him complete copies of the minutes of judicial sessions, however, in the opinion of the Judicial Collegium, his requests were unreasonably rejected," runs the statement of Ekaterinburg judges.

Also, the Tagilstroj Court has failed to send copies of the cassation complaints of his advocates to the convict, and "carelessly documented the case."

The Sverdlovsk Regional Court has returned the case back to the court of the first instance for elimination of these legal violations.
