Ingush activist Bagaudin Myakiev achieves verdict cancellation

The Fifth Cassation Court in Pyatigorsk has considered the complaint lodged by Bagaudin Myakiev, an Ingush activist, and overturned the sentence passed for an alleged use of violence against a state servant. The cancellation means sending the case for a retrial, Magomed Aushev, an advocate, has explained.

The "Caucasian Knot" has reported that on August 27, 2020, Bagaudin Myakiev, convicted for attacking law enforcers at a rally in Magas, was released from penal colony No. 6 in the Stavropol Territory after serving his term.

Bagautdin Myakiev was detained in April 2019, shortly after a rally in Magas. On February 20, 2020, the Ingush activist was sentenced to one year and nine months of imprisonment in a penal colony. The defendant admitted that at the rally he threw chairs in the direction of law enforcers, but said that he did not aim at fighters of the National Guard of Russia.

On January 18, 2022, the above Cassation Court cancelled Myakiev's verdict, the "Kavkaz.Realii"* outlet reported on the same day.

The cancellation of the verdict means sending the case for a retrial, Myakiev's advocate, Magomed Aushev, has explained.

"During the criminal trial, Bagaudin Myakiev refused to plead guilty. He had intended to challenge the verdict from the very beginning, as he treats it as illegal," the "Fortanga.org" has quoted Mr Aushev as saying on January 18.

Myakiev himself has stated that he had no hope for an acquittal, but hoped that the motive of political enmity, added into the indictment by the Stavropol Territorial Court, because of which the activist spent additional four months in jail, would be removed from the verdict. "I want to be compensated for this time, although I treat the entire sentence as illegal," Bagaudin Myakiev has stated.
