Case on attack of natives of Chechnya on MfE employees in Vnukovo returned to prosecutor

The Scherbinka District Court of Moscow has ruled to return the criminal case against three natives of Chechnya accused of assaulting employees of the Ministry for Emergencies (MfE) to the prosecutor; however, the court did not change their freedom restraint measure.

The "Caucasian Knot" has reported that Khamid Razhapov, Said-Magomed and Khamzat Tsetiev were detained in September, 2014. According to investigators, they beat up three MfE employees near the Moscow settlement of Vnukovo. On October 2, 2015, all the three declared their innocent and that they had alibi.

According to detainees' advocates, the decision to return the case to the Prosecutor of the Western Administrative District of Moscow was made at the session of the above court on 13 July.

One of the advocates, Nikolai Dyakov, explained that the court has found that the case files lack the statement of taking the criminal case to consideration.

According to the defence, the case files lack the flash stick, containing detailed subscribers' connections, the hard drive, which contains the data of the digital video recorder (DVR) on the day of the crime, and the pistol, confiscated during the inspection of the scene on September 23, 2014, which later was examined and put into the basis of charges.

The state prosecutor objected to the return of the case to the prosecutor, considering that there were no legal grounds for such decision, said Tatiana Okushko, another advocate.

The court rejected the defence's motion on changing the detainees' freedom restraint measure.
