Participation in the SVO allowed the security officer to avoid responsibility for the death of Khalit Mustafayev

The Predgorny District Court of Stavropol has terminated the criminal prosecution of a police officer who returned from the SVO zone for abuse of power. The father of Khalit Mustafayev, whom the security officer shot during a chase, called the decision unfair.

As "Kavkazsky Uzel" wrote, the head of the Ministry of Internal Affairs department in Lermontov apologized for the death of Khalit Mustafayev, whom one of the security officers shot during a chase in 2020. A case of abuse of power was opened against the security officer, but the proceedings were suspended because the accused went to the SVO. The apology for the death of Stavropol resident Khalit Mustafayev during a chase was four years late, his father said. He demands that the police officers be held accountable, one of whom went on a military operation, while the other is only a witness in the case.

The security officer, against whom a criminal case was opened in connection with the death of Khalit Mustafayev, returned from the special military operation zone with three awards and asked the court to dismiss his criminal case. Today, the Predgorny District Court of the Stavropol Territory granted his petition. Khalit's father, Bakir Mustafayev, called the decision "unfair," the Anti-Torture Team* reported.

"With the conclusion of a contract for military service, a criminal case can be dismissed at any stage. There was an indestructible institution - prison: a place where a person did not want to go. Now all this can be instantly canceled. And what should the victims do? The legislator did not offer them anything, thereby forgetting about the Constitution, which guarantees access to justice and protection by the same state that writes off all the sins of criminals," commented the head of the Team Against Torture* Sergei Babinets on the decision.

As follows from the case card on the court's website, the hearing on the case against the security officer under the article on abuse of power (part 3 of article 286 of the Criminal Code of the Russian Federation) was scheduled for today; there is no information about the decision made on the court's website.
