Bastrykin reacts to appeal on violation of housing rights of Kuban residents

In their video appeal to Alexander Bastrykin, the Chairman of the Investigating Committee of the Russian Federation (ICRF), a family from the Seversky District of the Krasnodar Territory (also known as Kuban by the name of the main river) told about how local authorities are preventing payments under the Kherson certificate, because of which people risk being left without their only housing. Mr Bastrykin has demanded to conduct a check.

In their video appeal, the members of the family that moved to Kuban from the city of Kherson claim that regional authorities are preventing payment under the Kherson certificate for the house they live in. The house in the village of Kaluzhskaya, purchased under the certificate, is the only home of this family. If the Krasnodar Territorial Administration fails to make the payment, the former owner of the house can evict the family out through the court.

A video about the situation of the family from the village of Kaluzhskaya was posted on June 23 by the blogger, Igor Scherbatsky, on his resources. He explains that the family had bought the house partly for their own savings, and the second part was covered by the Kherson certificate. The former house owner still has not received the payment under the certificate and sounded the alarm; the buyers began sorting out the situation and got drowned in correspondence with various agencies and courts.

The head of the family Igor by name has stated that in Kherson they were among the first to receive Russian passports. According to his story, 4,700,000 roubles were to be paid for the house under the Kherson certificate. "The former owner entered our situation; he has been waiting for the payment for two years and has not gone to court yet," Igor has noted.

The court has already ruled in favour of the family, but various structures continue suing this family. "We’ve already had nine court hearings and each time the hearing is postponed because no one understands what to do in this situation," says Igor.

"I’d like to do something in the house, buy something, and develop as a family. But we can't do anything because we don't know what future awaits us," Lyubov, Igor’s wife, has complained.

Today, it became known that the ICRF Chairman, Alexander Bastrykin, has requested a report on the appeal of the above Kuban family about the violation of their housing rights.

"A video appeal to the ICRF head of a family from the village of Kaluzhskaya in the Krasnodar Territory was posted in a social network with a request to give a legal assessment of regional authorities’ actions, who, in the family’s opinion, deliberately prevent payment of the housing certificate for the home where they currently live. According to experts, in the absence of payment, the former house owner has the right to demand their eviction from their only home. Local authorities appeal against the court ruling made in favour of the family," says the report posted in the ICRF’s Telegram channel.

In connection with the announced situation, the Krasnodar Territorial Branch of the ICRF has launched a procedural check.

"It’s important to note that the above Branch began the check yesterday," Igor Scherbatsky has written today in his Telegram channel. "Besides, after the release of the report, messages began arriving from other Kuban residents who have also failed to receive due payments under their Kherson certificates."
