Municipal deputies demand to cancel transhumance law in Dagestan
The deputies of the Kumtorkalin District have sent a draft law to the Dagestani Parliament on the abolition of the transhumance law (on distant pasture animal husbandry), explaining that it contradicts the laws. Earlier, the deputies of the Babayurt District also demanded to cancel the law.
The "Caucasian Knot" has reported that in July 2022, the Constitutional Court (CC) of Dagestan found it necessary to transfer the inhabited lands of distant pasture animal husbandry into the status of lands of dwelling settlements and legalize those settlements that had spontaneously formed on them. After that, more than 100 residents of the flat regions (of the Kayakent, Babayurt, Kumtorkalin, Kizilyurt and Karabudakhkent Districts) held a gathering in Makhachkala. They demanded to cancel the CC's resolution treating it as "legalization of land acquisition."
In 2022, three MPs of the People's Assembly of Dagestan (Salikh Gadjiev, Mukhudin Mukhudinov and Mayirbeg Alkhasov) applied to the Dagestani CC. In their opinion, the fact that the lands of distant pastures belong only to the category of "agricultural land" violates the constitutional rights of the citizens who live on these lands. The problems include the supplies of drinking water and electricity, the motor roads, absence of postal service, as well as the commissioning of social facilities, such as schools, the above MPs have pointed out.
In their opinion, as a result of the legal uncertainty of the status of the distant pasture lands in question, "many violations" of the land, tax and budget legislation in the Babayurt District remain unresolved.
