Court ignores advocates' arguments about violations in "Memorial"* property case

The decision to transfer the property of the "International Memorial"* to the state was made with violations of the law, the advocates have pointed out at the consideration of the appeal at the Moscow City Court (MCC), but their arguments failed to convince the judge. The outcome of the trial has shown the true attitude of the state towards the victims of political repressions, said Yan Rachinsky, the chairman of the board of the "Memorial"* that had been liquidated by the court.

The "Caucasian Knot" has reported that on Wednesday (February 8), Muscovites came to the court to support the "International Memorial"* in a dispute over the legality of transferring its office to the Research and Educational Centre. The MCC has upheld the earlier court ruling to transfer the building of the "International Memorial"* to the state.

In September 2022, at the demand of the Russian General Prosecutor's Office (GPO), the court arrested the office of the liquidated "International Memorial"*, donated to another organization. Human rights defenders treated the ruling as an attempt to raider seizure of property.

By its decision to deprive the Scientific-Informational and Educational Centre (SI&EC) "Memorial" of its property, the first-instance court satisfied the GPO's claim, which demanded to invalidate the transfer of the property in the form of premises on located Karetny Ryad Street in Moscow.

The advocates for the SI&EC "Memorial" have treated the court's conclusions about the recognition of the transfer fake as erroneous. In particular, Diana Sork has pointed out that there were no legal grounds to prohibit the "International Memorial"* from making deals with its property after the liquidation decision.

Yan Rachinsky, the board chairman of the "International Memorial"*, intends to use all the legal instruments to protect the interests of his organization.

*The organization was included by the Russian Ministry of Justice (MoJ) in the register of NCOs, performing the functions of a foreign agent, and was liquidated by a court’s decision.
