In Stavropol, court refuses to consider claim filed by mobilized father of disabled child

In Stavropol, a court has refused to consider a complaint filed by a local resident who disputes the draft to the army within the military mobilization due to the fact that he has two dependent children, one of whom is sick. Despite the above, the man has been mobilized and sent to the air assault regiment.

The “Caucasian Knot” has reported that after the announcement of the partial mobilization in Russia, reports began to come about attempts to mobilize those men who should not be sent to the combat zone. In several regions, including the Rostov and Astrakhan Regions, some mobilized people managed to return home.

The man who filed a complaint to the court has the experience of military service in 1998-2000 only. On September 26, he was summoned to the military registration and enlistment office and appointed commander of an economic department in a military unit. One of the mobilized man’s children suffers from a neurological disease, the “Kavkaz.Realii”* reports.

Let us remind you that on October 4, the Ministry of Defence (MoD) reported that Russian Defence Minister Sergey Shoigu instructed his subordinates to urgently bring to the military registration and enlistment offices the clarifications concerning the draft deferment for fathers of children with severe incurable diseases or fathers of three children, one of whom is disabled. On October 13, Andrei Kartapolov, the chair of the State Duma Committee on Defence, explained that a decision had been made on the draft deferment for fathers who have three or more dependent children under 16 years of age. State Duma Speaker Vyacheslav Volodin also announced that fathers of three or more children are exempt from mobilization.

“An oral order may not be executed, because it is not a legal document,” said Artyom Mugunyants, the leading lawyer for work with conscripts at the “Anti-Draft Centre”, when commenting on the situation.
