Kuban resident banned to return home prior to consideration of his mobilization complaint
The lawsuit concerning mobilization lodged by Alexei Abramov, a resident of Goryachiy Klyuch, who was diagnosed with multiple spinal injuries, against the military commissariat, has been accepted for consideration, Mikhail Benyash*, an advocate, has informed, adding that the judge refused to suspend, for the time of the litigation, the enforcement of the drafting commission's decision to send Alexei to the frontline.
The "Caucasian Knot" has reported that on October 27, the court dismissed the lawsuit about the mobilization lodged by Alexei Abramov, a local resident, against the local commissariat. His advocate filed a repeated lawsuit, which was sent to the same judge for consideration.
On November 3, Mikhail Benyash, an advocate, announced in his Telegram channel that the judge had accepted the second lawsuit lodged in the interests of Alexei Abramov, a resident of the town of Goryachiy Klyuch (Krasnodar Territory, also known as Kuban by the name of the main river), but refused to "satisfy the preliminary measures," that is, to suspend, for the time of consideration, the enforcement of the decision of the drafting commission, because "no sufficient grounds for the application of the above measures were presented."
Mr Benyash has stressed that the suspension of the drafting commission's decision is important for Abramov, since "delay can lead to his disability", as Alexei is now at the frontline, the "Kavkaz.Realii"** project has reported.
In Southern Russia, attempts have been recorded to mobilize people who, due to their age or health status, should not be sent to the combat zone. The absence of medical commissions in the military commissariats is a violation of the law, Anton Getmanenko, a lawyer, has stated.
