SC dismisses appeal against Zarema Musaeva's arrest

The Supreme Court (SC) of Chechnya has considered the complaint against the ruling of the first instance court to extend the arrest of Zarema Musaeva until July 12, and refused to satisfy it, Dmitry Kazakov, a lawyer for the "Team against Torture", has informed.

The "Caucasian Knot" has reported that on June 10, a court in Grozny extended Zarema Musaeva's arrest until July 12. Musaeva, who suffers from diabetes, is feeling worse in custody, her son, Abubakar Yangulbaev, has stated.

Zarema Musaeva, the wife of Saidi Yangulbaev, a former federal judge, was taken away by law enforcers from Nizhny Novgorod to Grozny on January 20, 2022. On February 1, the woman was charged with assaulting a law enforcer. On February 11, her son pointed out that Zarema Musaeva has diabetes mellitus with multiple complications, and that jails, special detention centres and SIZOs (pre-trial prisons) cannot keep people with this disease.

On June 23, the Chechen SC dismissed the appeal lodged by Musaeva's defence against the decision of the Grozny court to extend her arrest, the lawyer, Dmitry Kazakov, from the interregional public association "Team against Torture", told the "Caucasian Knot" correspondent.

According to the lawyer, the defence had noted the formal approach of the first instance court in extending Musaeva's arrest. "The main arguments of the complaint were that the ruling of the first instance court was unjustified, as the court failed to take into account Musaeva's health condition," Mr Kazakov has explained.

He has added that the first instance court had also superficially analyzed the possibility of using an alternative freedom restriction measure. He has also stressed that in the complaint, the defence did not offer any of such alternative measures, just asked to cancel the arrest extension. This motion was dismissed.
