Russia refuses to comply with ECtHR’s decision concerning law on foreign agents

The European Court of Human Rights (ECtHR) considered complaints filed by 73 Russian NGOs against the Russian law on foreign agents and recognized it as inconsistent with the right to freedom of association. The ECtHR awarded compensation for moral and material damage to be paid to the complainants. Russia will not comply with the decision of the ECtHR, the Russian presidential press secretary announces.

The “Caucasian Knot” has reported that on June 2, the Moscow City Court did not grant the motion to suspend the liquidation of the Human Rights Centre (HRC) “Memorial”* until the decision of the ECtHR on the complaint against the law on foreign agents. A public prosecutor accused the HRC “Memorial”* of participating in protest movements and called the lists of political prisoners misinforming citizens.

On March 22, the Supreme Court (SC) of Russia also held a hearing on the motion filed by the “International Memorial” (International Historical Educational Charitable and Human Rights Society “Memorial”)*, which asked for a suspension of its liquidation until the decision of the ECtHR on the complaint against the law on foreign agents. According to the defence, such a prolongation was the responsibility of the Russian court, but the Supreme Court did not grant the motion.

On June 11, President Vladimir Putin signed laws establishing a deadline for the execution of ECtHR judgments in the Russian Federation. According to the new laws, ECtHR judgments pronounced after March 15, 2022 are not enforceable in Russia.

*The organization was included by the Russian Ministry of Justice (MoJ) in the register of NCOs performing the functions of a foreign agent and was liquidated by a court decision.
