ECtHR awards relatives of Chechen native 24,000 euros for his death in penal colony

Relatives of Molda Kaimov, sentenced in Chechnya for an attempt on a policeman and involvement in the armed underground, have succeeded in seeking compensation through the European Court of Human Rights (ECtHR) in the amount of 24,000 euros for his death from tuberculosis in a penal colony.

Molda Kaimov was suffering from pulmonary tuberculosis yet before his detention. In a SIZO (pre-trial prison), the man got medical treatment. However, in a penal colony, the prisoner was not provided with medical assistance, so his condition began to deteriorate. On July 1, 2010, Molda Kaimov died in the penal colony.

Several days before his death, the prisoner told an advocate from the "Legal Initiative" that he had not got any medicine, since there were no drugs in a prison hospital, but the penal colony administration forbade a transfer of drugs to prisoners.

The European Court of Human Rights (ECtHR) has recognized that the Russian authorities had violated their obligation to protect the life of the prisoner and his right to life guaranteed by Article 2 of the European Convention on Human Rights.
