Guseinov’s defence states contradictions in case against blogger to ECtHR’s decisions

The case of defaming the police by the blogger Mekhman Guseinov cannot be a criminal one, since, according to the case law of the European Court of Human Rights (ECtHR), defamation cases are considered in the civil process. This was stated by Elchin Sadygov, a Guseinov’s advocate. Guseinov himself intends to continue his blogger’s activities.

The "Caucasian Knot" has reported that today the Surakhani District Court of Baku has accepted to consideration the lawsuit lodged by Musa Musaev, the Head of Nasimi District Police Department against Mekhman Guseinov. The case was initiated under the defamation article: after his arrest on January 9, the blogger stated his torture by the police.

According to Guseinov, during his detention, policemen broke his nose and kept him for four hours in a car with a bag over his head.

Guseinov has noted that "in fact he was exposed to defamation."

His advocate has pointed to non-justification of lawsuit and its incorrect consideration by the Surakhani District Court, since the blogger had made his statement about the torture in front of the building of the Nasimi District Court, that is, in the territory of the Nasimi District.
