Defence asks to stop prosecuting figurant in banditry case of Kizilyurt policemen

The defence of Magomed Piraev, a figurant of the case on banditry of policemen of the Kizilyurt ROVD (District Interior Division), has petitioned before investigators to stop prosecuting him for lack of evidence.

The "Caucasian Knot" has reported that Askhabali Zairbekov, the boss of the Kizilyurt ROVD, and his subordinates Gaziyav Djamaludinov, Makhmud Khaibulaev, Magomed Piraev and Abdulmuslim Magomedov are accused of banditry, robbery, hostage-taking, embezzlement and illicit arms circulation. On March 20, the Supreme Court of Dagestan returned the case to the Prosecutor's Office, because the indictment had been compiled with violations of the Code of Criminal Procedure of the Russian Federation.

The case was returned to the Prosecutor's Office, as the judicial board found in the indictment "the presence of substantial inconsistencies contained in the descriptions of two episodes of robbery," says the definition of the Supreme Court of Dagestan of March 20, 2015.

After the return of the case to the Prosecutor's Office, some wordings were changed, but the indicted articles of the Russian Criminal Code remained the same, said Salimat Kadyrova, the Piraev's advocate.

According to her story, after the repeated study of the case, the defendants and several advocates put forward several motions. Advocates of other figurants of the case also asked investigators to carry out additional investigatory actions.
